Fields, (303) 287-4656 <br />Section 26, Twp 6 North, Rng 66 West, 6th P.M., Weld County <br />COMMENTS: The applicant has requested a partial acreage release for a 9.36 -acre parcel, which will <br />reduce the total acreage remaining within the mining permit boundary from 90.63 acres to 81.27 acres. <br />The 9.36 acres requested to be released from the permit boundary is owned by Varra Companies, Inc., <br />and contains their concrete batch plant and related roads, structures, and stockpiles. The parcel has <br />been fully reclaimed as intended for industrial use. The 9.36 -acre parcel is separate from and was not a <br />part of L.G. Everist's slurry wall construction and reclamation operations in the last year. This office has <br />no objection to the requested partial acreage release. <br />The Star Water Resource (formerly the Feit Pit) is included in the L.G. Everist Combined Substitute Water <br />Supply Plan (WDID 0202618), as amended May 26, 2015, which is valid for operation through December <br />31, 2015. The amended SWSP covers depletions from evaporation of 2.2 acres of ground water exposed <br />to the atmosphere after December 31, 1980, and the use of 1 acre-foot of water for dust control purposes <br />at the Star Water Resource. The remaining 81.27 -acres within the Star Water Resource mining permit <br />boundary must continue to be included in a substitute water supply plan until a liner approval is obtained <br />from this office or the site has been backfilled to its pre -January 1, 1980 area, and lagged depletions to <br />the stream system from past operations at the site have ceased. <br />The applicant may contact the State Engineer's Office with any questions. <br />✓ AF & Report <br />✓ VIOLATION: MV -1994-020 <br />1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 555.555.5555 www. water. state. co. us <br />
