Bowie follows the conditions in the draft permit while operating under this enforcement <br />discretion. <br />2. This enforcement discretion will expire 60 days from issuance or when the new permit is issued <br />to Bowie. <br />Please note that since the Division has not yet finalized the permitting action for this site, Bowie <br />assumes all of the risk associated with the project, which could include necessary modifications to the <br />equipment and site design among others. Bowie must continue to work with the division to resolve <br />permitting issues. If, in the Division's judgment, Bowie does not continue to work cooperatively <br />towards the issuance of a construction permit, this discretion may be terminated.
