Based on your email of August 15, 2013 requesting the ability to use the new gob pile, the Division
understands that the use of the new gob pile will provide Bowie with operational flexibility to continue
operations.
Based on this information and understanding the Division hereby approves Bowie to use the new bob
pi lc under the following conditions:
1. Bowie follows the conditions in the draft permit while operating under this enforcement
discretion.
2. This enforcement discretion will expire 60 days from issuance or when the new permit is issued
to Bowie.
Please note that since the Division has not yet finalized the permitting action for this site, Bowie
assumes all of the risk associated with the project, which could include necessary modifications to the
equipment and site design among others. Bowie must continue to work with the division to resolve
permitting issues. If, in the Division's judgment, Bowie does not continue to work cooperatively
towards the issuance of a construction permit, this discretion may be terminated. Failure to cease
operations upon Division notice subjects Bowie Resources to potential enforcement,
