New Cache La Poudre Irrigating Company <br />Case Nos. 0 1 CW20 1 /0 1 CW288 and 04CW343 <br />Page 4 of 20 <br />4.6. A Stipulation with the Greeley Irrigation Company was entered into on September 28, <br />2010. <br />4.7. A Stipulation with the City of Thornton was entered into on October 29, 2010. <br />5. Summary of Consultation. The consultation between the Office of the Division Engineer and <br />the Water Referee was held in Case No. 2001CW201 on May 16, 2003. The Summary of <br />Consultation was duly served on those in opposition in Case No. 2001CW201 on June 4, <br />2003. A consultation between the Division Engineer and the Water Referee in Case No. <br />2001CW288 was held on May 10, 2002 and a summary of that consultation was also duly <br />served on those in opposition. A consultation between the Division Engineer and Water <br />Referee was held in Case No. 04CW343 on April 5, 2005 and a copy of the consultation was <br />served on all parties to the case. Responses to the summaries of consultation in Case No. <br />OICW201 and 04CW343 were provided by Applicant on September 16, 2004 and July 29, <br />2005 respectively. <br />6. Notice and Jurisdiction. All notices required by law of the filing of the applications in this <br />matter have been fulfilled, and the Water Judge has jurisdiction over the subject matter of the <br />applications in this matter and over all persons and property affected by it, irrespective of <br />whether they or its owners have appeared. The water and lands that are the subjects of the <br />applications in this matter are not located in a designated groundwater basin. <br />7. Conditional Water Rights. Applicant has requested confirmation of the following conditional <br />water rights for the following structures: <br />7.1. The Cornish Plains Reservoir and Recharge Facility (hereinafter "Cornish Plains <br />Reservoir'). The Cornish Plains Reservoir is an off -channel reservoir located within <br />portions of the following: the NW '/4 of the SE '/4, the SW '/a of the SE '/4, and the SE '/a <br />of the SE '/4 of Section 5; the E % of the NW '/4, the entire NE '/4, and the N %2 and the SE <br />'/4 of the SE '/a of Section 8; and the SW '/a of the NW '/4 and the W %z of the SW '/4 of <br />Section 9, Township 6 North, Range 63 West of the 6a' P.M. <br />7.1.1. Points of diversion: <br />7.1.1.1. The headgate of the Greeley No. 2 Canal, located at the SE '/4 of <br />the NE '/4 of Section 11, Township 6 North, Range 68 West of the 6t' <br />P.M., in Larimer County, Colorado. <br />7.1.1.2. The John Law Seep Ditch point of diversion into the Greeley No. 2 <br />Canal, located at the confluence of the John Law Seep Ditch with the <br />Greeley No. 2 Canal, located in the NW'/4 of the SW'/4 of Section 14, <br />Township 6 North, Range 67 West of the 6t' P.M., Weld County, <br />Colorado, at a point approximately 5,250 feet west of the east section line <br />and 1,500 feet north of the south section line. <br />
