There will be no water used with the mining operation, other than for dust control as <br />needed. The New Cache La Poudre Irrigating Company has suitable water in storage for this <br />project. A copy of a portion of the final Water Court decree is attached. The decree states <br />the uses in paragraph 7.4 on page 7. As of April 30, 2015 there was 1511 acre-feet of water <br />in the Cornish Plains Reservoir designated for these purposes. The accounting for the <br />reservoir is submitted to the Division of Water Resources. The estimated need for the <br />project is about 3200 gallon per day. Over the estimated time for the project (about 30 days) <br />the amount of water needed for dust control would be approximately one-third of an acre- <br />foot (about 100,000 gallons). <br />7. The encountering of ground water is not anticipated. <br />8. The mining will be done above the water table. <br />9. Colorado water laws and regulations governing injury to existing water rights is not <br />applicable in this operation. <br />10. The affected area is located in a rural area; no refuse, acid, or toxic producing materials will <br />be encountered. If these materials are found, they will be disposed of per Colorado laws and <br />regulations. <br />11. The operation should be considered by the Division as a "continuous" operation. <br />12. The primary and secondary commodities generated will topsoil, gravel and dirt for <br />commercial purposes. This is not a commercial gravel pit.
