C: 432 / et seq. <br />TR100 was compared to the current EA (DOI-BLM-CO-S050-2013-0010 EA, September <br />2013). The mining method and its environmental effects will not change from those <br />analyzed in the EA. The mining permit issued by the State addresses mitigation of potential <br />adverse environmental effects identified in the EA. If major adverse effects occur, <br />compliance with the permit will identify them and require mitigation. <br />(())Any change in the mining operations and reclamation plan that would result in a change in the ostmining <br />land use where the surface is federally -owned. <br />TR100 proposed no change in the postmining land use. <br />It is OSMRE's determination that TR100 does not require a MPDD. Therefore, a mining <br />plan approval from the ASLMM is not required. OSMRE's decision was based upon <br />consideration of the Federal regulations under 30 CFR 740 and 746 and not the technical <br />aspects of TR100.
