.40Nal na
SIOZ , 7, M
To DBMS & Michael Cunningham:
This is a second letter of response to your letter that was signed on December 1, 2014
stemming from the unnecessary inspection on November 21, 2014. Your inspection was
warranted as a result of an illegal ATV criminal trespass on our private mining road performed
by Jeanne Andrews and another person back in 2014. Your department references her
information that was illegally collected, and supports that it is reason you came for the
inspection. Note that this personally witnessed and documented ATV criminal trespass and
illegal unauthorized collection of photos with data of proprietary lodes and other private
information by Jeanne Andrews was used in lieu by your department as a means for your
inspection. As a citizen myself, this means to me , our company, and my community that
your department willingly and understandably uses illegally collected data and allows illegal
trespass via ATV's by third parties as a tool to help gather information out in the forest to
assist your procedures!
Atomic Perfection has completed the corrective actions as per requested by the DBMS
letter before June 1, 2015 for the Wild Blue Indian Mine CMC# 276299. Because we do not
feel that photos will accurately show the corrective measures requested by your office and will
not be sufficient, we would be happy to schedule a follow up inspection to be set on an
approved date by both parties, while a representative of Atomic Perfection will be present. We
believe that an actual field visit by your office will help you determine more accurately the
corrective measures performed over photos. As we are in complete compliance with the Plan
of Operations authorized by the Forest Service on 5-9-2013, and understanding the purpose
of the inspection was "to determine if the Operator was in full compliance with the plan", we
will continue to prospect for the duration of our 5 year plan effective until May 2018.
Additionally, to clear up any misunderstanding, we are approved and bonded for 1 full acre of
disturbance at a time as stated in the Plan of Operations. We are operating under 1 acre. The
DRMS has already done a review of the reclamation cost estimate and found it to be
technically adequate. Also, your letter stated incorrectly that we have been prospecting for a
period of 5 years when actually we have only been prospecting for a period of 2 years under
the current Load Claim Plan of Operations. Our type of Operation is a Lode Claim and The
Plan of Operations for which we are working under is commensurate with the Division's
Reclamation Permit.
SIC ,4CL V£
Sincerely, Mike ild -Atomic erfection
P.O.
