In such a weighting technique, a single <br />comparison would be made between all reference areas and the <br />entire revegetated area, and would be based on the relative area <br />occupied by each plant community in the premining surface. <br />(c) For reference areas as described in 4.15.7(3)(b)(ii) and (iii), <br />comparison of an individual reference area representative of a <br />specified ecological site based on soil, elevation and topographic <br />characteristics with a corresponding site on the revegetated <br />surface. <br />A For reference areas as described in 4.15.7(3)(b)(ii) and (iii), <br />comparisons of weighted averages between reference areas and <br />revegetated areas. In such a weighting technique, a single <br />comparison would be made between all reference areas and the <br />entire revegetated area, and would be based on the relative area <br />occupied by each ecological site on the revegetated surface. <br />120(2){t) (5) The liability period under the performance bond requirements of 3.02.3 <br />begins after the last year of augmented seeding, fertilization, irrigation <br />or other work. The liability period shall continue for not less than <br />either five (5) or ten (10) years, as appropriate, as described in 3.02.3. <br />The revegetation success criteria as defined in relevant subsections of <br />4.15, shall be met for at least two of the last four years of the liability <br />period. Sampling for final revegetation success shall not be initiated <br />Prior to year nine (9) of the liability period. The liability period shall <br />re-initiate whenever augmented seeding, planting, fertilization, <br />irrigation, or other augmentive work is required or conducted. <br />Management activities that are not augmentive and are approved as <br />normal husbandry practices may be conducted without re -initiating the <br />liability period under the following specified conditions: <br />(a) Repair of rills and gullies of limited areal extent, which do not <br />result from deficient backfilling and grading or deficient surface <br />drainage design or implementation, is a normal husbandry <br />practice. To be considered of limited areal extent, no more than <br />five percent of the acreage initially revegetated during any one <br />year shall be reaffected by rill and 9t111y repair or revegetation. <br />Revegetation treatments specifically necessitated by repair <br />activities are part of these practices. The nature, location and <br />extent of erosion repair work must be fully described in the annual <br />reclamation report. <br />
