1k
GCC Energy Response
Upon realizing the stockpile had exceeded the disturbed boundary (Inspection on April
21, 2015), work was started immediately to:
"Retrieve all coal from the area that was previously undisturbed, from which topsoil
has not been salvaged, and from the collection ditch that is surrounding the coal
storage pad at Stack Tube #2."
In addition to the cleanup of the coal and re-establishing the disturbed area runoff
collection ditch, stakes will be installed to delineate the boundary for the stockpile and
avoid the undisturbed area and operators have been instructed on stockpile
management to prevent a future occurrence.
Results of the corrective actions include:
➢ abatement was completed prior to the due date
➢ topsoil was not disturbed and was left in-place
➢ additional disturbance was not required to extend the stockpile
➢ administrative procedures established for stockpile management
Considering GCC's past track record and with the expedient, corrective actions to
abate this violation (including additional procedures implemented to prevent future
non-compliance), GCC feels that we have demonstrated our commitment to continued
protection of the environment and regulatory compliance.
Thank you for your time and consideration on this matter. If you have any questions
or comments, please contact Seth McCourt at 970.385.4528 x 6527 or Tom Bird
x6503.
Sincerely,
Seth McCourt
Senior Engineer
GCC Energy, LLC
