1k <br />GCC Energy Response <br />Upon realizing the stockpile had exceeded the disturbed boundary (Inspection on April <br />21, 2015), work was started immediately to: <br />"Retrieve all coal from the area that was previously undisturbed, from which topsoil <br />has not been salvaged, and from the collection ditch that is surrounding the coal <br />storage pad at Stack Tube #2." <br />In addition to the cleanup of the coal and re-establishing the disturbed area runoff <br />collection ditch, stakes will be installed to delineate the boundary for the stockpile and <br />avoid the undisturbed area and operators have been instructed on stockpile <br />management to prevent a future occurrence. <br />Results of the corrective actions include: <br />➢ abatement was completed prior to the due date <br />➢ topsoil was not disturbed and was left in-place <br />➢ additional disturbance was not required to extend the stockpile <br />➢ administrative procedures established for stockpile management <br />Considering GCC's past track record and with the expedient, corrective actions to <br />abate this violation (including additional procedures implemented to prevent future <br />non-compliance), GCC feels that we have demonstrated our commitment to continued <br />protection of the environment and regulatory compliance. <br />Thank you for your time and consideration on this matter.
