PERMIT #: M-2004-017 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: May 8, 2015 <br />Mischaracterization of drainage in the mining application <br />The complaint letter states the permit application contradicts the direction of drainage at the site. The <br />potential drainage of stormwater at the site was estimated to be from the northeast to southeast during the <br />inspection. The perimeter of the site was bermed and no release of stormwater was identified during the <br />inspection. The Operator must maintain appropriate stormwater controls throughout the life of the mining <br />permit. <br />Disposal of imported material and debris by burning <br />The complaint letter states imported material and debris was burned at the pit in 2006 and 2015. The <br />Operator stated a burn permit was issued by the County in 2006 and the smoke observed in 2015 was from <br />starting equipment at the site. The Division does not have jurisdiction over burning at the site. <br />No affidavit regarding the importation of material <br />The complaint letter states the Operator has imported various materials at the site. The temporary <br />importation of inert material, concrete and asphalt, does not require an importation affidavit by the Division. <br />Stockpiles of concrete and asphalt were observed during the inspection. The Operator stated the stockpiles <br />would be processed and removed from the site in the future. <br />The Operator stated salt was imported in the past to create a product for CDOT. The Operator stated the salt <br />was stored properly while at the site and has been removed from the site. No evidence of salt was observed <br />during the inspection. <br />The Operator stated overburden material has been imported to backfill the highwall in the northwest corner <br />of the site. As cited as a problem above, the Division will require the Operator to submit an affidavit as <br />required by Rule 3.1.5(9) for the structural fill generated outside of the approved permit area. <br />The junk and debris in the old pit area has been cleaned up by the Operator. Half of the old tires were hauled <br />away by a recycling company recently. The remaining tires were schedule to be removed soon. A photograph <br />of the cleaned up pit floor is attached. <br />Nonconformance with enforceable conditions in the permit <br />As noted in the previous inspection report and noted in Mrs. McIntyre's letter, the northeastern highwall has <br />been mined at a approximate 1H:1V slope and to within ten feet of the permit boundary. As cited as a <br />problem above, the Division will require the Operator to backfill the highwall to establish the required 25 foot <br />offset from the eastern boundary and the required 3H:1V slope within 60 days of the mailing date of this <br />report. <br />The complaint letter discusses noise and dust issues at the site. The Division does not regulate noise impacts. <br />The County is responsible to set and enforce noise limits. The photograph of dust included in the letter was <br />reported by the Operator to be exhaust from the start up of the generator at the site. The Operator stated an <br />APEN permit is approved for the site. <br />As noted in the previous inspection report and noted in Mrs. McIntyre's letter, noxious weeds, including <br />Scotch Thistle and Oxeye Daisies, were observed at the site. The Operator stated a weed control company has <br />been hired to spray and monitor the site for weeds in the future. As cited as a problem above, the Division <br />will require the Operator to submit proof of weed control spraying within 60 days of the mailing date of this <br />Page 3 of 6 <br />
