May 2515 09:45a Joellen 9708647682 p.2
Division of Reclamation, Mining, and Safety
1313 Sherman Street Room 215
Denver, Colorado 80203
May 22, 2015
RE: Pond 11 and Monitor wells located on the Morgan Property
Dear Mr Hernandez and Mr. Bowles: This is a formai request to
have pond 11 be reclaimed back to being a part of the prime
farmland field that it was prior to mining, right away. Water bodies, if
any, to be constructed during mining and reclamation operations
must be located within the post reclamation non -prime farmland
portions of the permit area. The creation of any such water
bodies must be approved by the Division and the consent of
ALL property owners within the permit area must be obtained.
We had strongly objected to a pond being put on this place and
no permission was ever acquired. The State insisted that we had
no choices and that it had to be built there. The next thing we
knew it was there. We had always requested that it be built
directly across the fence which always made more sense to us
and would have not been on prime farmland fields. This pond
