As Part <br />of a minor revision(1.04(73)) , We are requesting that pond 11 <br />be reclaimed this week or as soon as possible because we will <br />be planting the permanent crop of alfalfa and the cover crop of <br />oats within the next two weeks as weather permits. Per rule <br />4.25(4) The aggregate total prime farmland acreage shall not be <br />decreased from what existed prior to mining. Water bodies, if <br />any, to be constructed during mining and reclamation operations <br />must be located within the post reclamation non -prime farmland <br />portions of the permit area. The creation of any such water <br />bodies must be approved by the Division and the consent of <br />ALL property owners within the permit area must be obtained. <br />We had strongly objected to a pond being put on this place and <br />no permission was ever acquired. The State insisted that we had <br />no choices and that it had to be built there. The next thing we <br />knew it was there. We had always requested that it be built <br />directly across the fence which always made more sense to us <br />and would have not been on prime farmland fields. This pond <br />
