Mined Land Reclamation Board <br />Room 215 <br />1313 Sherman Street <br />Denver, CO 80203 <br />May 13, 2015 <br />""0 6jm"O " <br />* Of <br />Reference (M-1986-074) <br />Dear Mined Land Reclamation Board, this is a second letter that I am sending to you. <br />After reviewing the Sand Creek Estate Subdivision covenants, conditions, <br />restrictions and the parcel map, I have more concerns. <br />First of all, the expansion area would include lot 6, 7 and 8 of the Sand Creek Estates <br />Homeowners Association, referred to from now on as SCEHA. This expansion of M- <br />1986-074 would also include some of the common area, which belongs to SCEHA. <br />The common area is shown on the parcel map as Cameron Road. Cameron Road <br />does not belong to Kym Schure it belongs to SCEHA. <br />The HOA's of this subdivision apply to all owners and lots. In section 1 of Article 11, <br />owners have a non-exclusive right and easement of enjoyment in and to the <br />Common Areas. In Article VII, Section 4 (b) Dust Control, under no circumstances <br />shall the owner of any lot or parcel or land disturb the natural soil or grass unless <br />the owner immediately thereafter, constructs on, paved, gravel or re -plants such <br />disturbed areas with ground cover. In Article VII, Section 4 (i) Use of Premises <br />states no commercial use and lists mining as one of the prohibited uses. Article VII, <br />section 9, no nuisances shall be permitted on properties, nor any use, activity or <br />practice which is the source of annoyance or embarrassment to or which offends of <br />disturbs, any residents of the properties, or which interferes with the peaceful <br />enjoyment of the possession of proper use of the properties. <br />Article VII, Section 1. General Plan. It is the intention of the Declarant to establish <br />and impose a general plan for the improvement, development, use and occupancy of <br />the Properties, all thereof in order to enhance the value, desirability, and <br />attractiveness of the Properties and sub -serve and promote the sale thereof. The <br />Declarant is Kym Schure. I do not see where the mining expansion will do any of <br />these items.
