NATURE OF VIOLATION.
This item is in regard to a Notice of a Possible Violation, corrective actions, a Cease -and -Desist Order, and civil
penalties for a possible violation of C.R.S. §34-32-101 et M., and specifically C.R.S § 34-32-116(7)(h) for
failure to protect areas outside of the affected land from slides or damages occurring during the mining operation.
A violation of the Act constitutes a violation of a permit provision.
CHRONOLOGY:
January 7, 2015 — The Division became aware that the Operator constructed a sediment pond, of which portions
were outside the affected area boundary.
April 21, 2015 - The Division of Reclamation, Mining and Safety (Division) conducted a follow-up monitoring
inspection of the site. The Division cited a possible violation for a mining disturbance (specifically, sediment
pond EMP009A), approximately 1.2 acres in size, outside of the affected area boundary.
April 23, 2015 - The Division sent the operator a copy of the inspection report and a Reason To Believe letter for
failure to protect areas outside of the affected land from slides or damages occurring during the mining operation.
