Mr. David Heintz <br />Duckworth SWSP <br />May 6, 2015 <br />Long -Term Augmentation <br />Page 8 of 10 <br />Final reclamation at the site will consist of two unlined ground water ponds with a <br />combined surface area of 37 acres. This will create long term injurious stream depletions if <br />not adequately replaced. In accordance with the letter dated April 30, 2010 (copy attached) <br />from the Colorado Division of Reclamation, Mining, and Safety ("DRMS"), all sand and gravel <br />mining operators must comply with the requirements of the Colorado Reclamation Act and <br />the Mineral Rules and Regulations for the protection of water resources. On December 5, <br />2012, DRMS received and accepted an increased bond for this site to cover the cost of lining <br />or backfilling in accordance with options 1 and 3 of the April 2010 letter. The Duckworth Pit <br />now has an actual surety amount of the required surety amount of $1,603,000 which can be <br />used to eliminate long term augmentation requirements by lining or backfilling the site should <br />the pit operator or land owner fail to obtain a sufficient augmentation plan after mining <br />operations are complete. <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of August 1, 2014 through July 31, 2015, unless <br />otherwise revoked, modified, or superseded by decree. A SWSP renewal request must <br />be submitted to this office with the statutory fee (currently $257) by June 15, <br />2015. <br />2. Welt permit no. 76922-F was obtained for the current use and exposed pond surface <br />area at the Duckworth Pit, in accordance with §37-90-137(2) and (11), C.R.S., and this <br />permit remains valid. <br />3. The total surface area of the groundwater exposed at the site must not exceed 0.34 <br />acres, resulting in evaporative losses of 0.44 acre-feet for this plan period. <br />4. The total amount of water used for dust control at the site must not exceed 4.35 acre- <br />feet. All pumping for dust control shall be measured with a totalizing flow meter to <br />the satisfaction of the Division Engineer. <br />5. The total amount of water lost in aggregate production at the site must not exceed <br />4.53 acre-feet from 308,000 tons of mined aggregate. <br />6. Total consumption at the site must not exceed the aforementioned amounts unless an <br />amendment is made to this plan. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />8. All releases of replacement water must be sufficient to cover all out -of -priority <br />depletions in time, place, and amount and must be made under the direction and/or <br />the approval of the water commissioner. The release of replacement water may be <br />aggregated to maximize beneficial use. The water commissioner and/or the division <br />engineer shall determine the rate and timing of an aggregated release. <br />9. Dewatering operations must be measured by totalizing flow meters that can accurately <br />show the monthly volume of water dewatered into the Cottonwood Pond, Lighthouse <br />Cove Pond ("LCP") and into the Smith ft Emmons Ditch. The Smith Et Emmons Ditch <br />must measure the dewatering water diverted directly back to the river. Any <br />dewatering water placed into LCP cannot be used for irrigation or any other purpose <br />
