Everist, Incorporated <br />Dear Mr. Scott: <br />L.G. Everist, Incorporated (aka L.G. Everist, Inc., Applicant, Operator) respectfully requests a Partial Acreage <br />Release of the Permit Area of Star Water Resource, M-1977-522_ We have attached and signed the Division's <br />form, "Request for Full or Partial Release of Permit Area". <br />L.G. Everist is requesting release of the 9.36 acre parcel within the permitted area, owned by Varra Companies <br />Inc., and which contains the Varra's concrete batch plant and related uses. When L.G. Everist amended the <br />DRMS permit last year (approval date 07/10/2014), we updated the reclaimed end use of this area from <br />residential to industrial, which reflects its current use and Greeley zoning. <br />The area to be released is fully reclaimed as intended - for industrial use, with a concrete batch plant and related <br />roads, structures and stockpiles. Most of the Varra area is graveled, with some native vegetation in non -traffic <br />areas. The Varra property and concrete batch plant operations were kept separate from, and were not a part of, <br />L.G. Everist's slurry wall construction and reclamation operations in the last year. <br />With this release, the permitted acreage will be reduced as follows: 90.63 - 9.36 = 81.27 acres. <br />L.G. Everist is not asking for a financial warranty reduction with this acreage release request because no bond <br />money was associated with these 9.36 acres. However, L.G. Everist completed mining and reclamation on the <br />rest of the site before the end of 2014, so after this partial acreage release is approved, we will send the Division <br />a separate request for a financial warranty decrease to reflect the substantially completed reclamation. <br />Because the site is reclaimed, we are just submitting a revised Exhibit F: Reclamation Plan Map (As -Built) to <br />accurately depict the acreage to be released and the new permit boundary. <br />If you need more information to process this acreage release request, please contact me (office - 303-286-2247, <br />email - Imshults@lgeverist.com).
