PERMIT #: P-2013-019 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: April 30, 2015 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham -of the Division of Reclamation, Mining and Safety <br />(Division). Craig Gardner of K & B Mining and Matt Collins were present for the inspection. The Badger a Group <br />of Mines (Badger) NOI is located approximately 2 miles east of Jamestown, Colorado in Boulder County. <br />The prospecting operations are currently taking place in the lower portal where active drilling was occurring <br />during the inspection. The pad around the lower portal contained a generator, several portable water tanks, <br />an explosive magazine (for equipment storage), and a small portable shed. The work pad is situated above a <br />seasonal stream which flows through Caste Gulch; the stream was flowing at the time of the inspection. The <br />work pad (mine dump) has filter fencing around the perimeter; no offsite erosion was observed. The lower <br />portal is located on unpatented claims in the Roosevelt National Forest; the U.S. Forest Service has issued a <br />Plan of Operations for this portion of the operation. <br />The access to the upper portal is located further downstream and traverses through private property; the <br />upper portal is located on patented claims. According to the Operator, no additional prospecting is planned for <br />the upper portal. A narrow trail leads from the upper parking area to the upper portal; chain-link and wood <br />fencing has been erected along the edge of the trail. A small plywood office has been constructed just above <br />the portal; the office is not currently in use. The upper portal has a closure consisting of a wood -framed <br />overhang with a chain-link gate; the gate was locked with a pad lock. The Division observed a second closure <br />adjacent to the upper portal. The second closure consists of steel door (approx. 2' x 3'), with a wood -framed <br />overhang. According to the prospector, the second closure was placed over a shallow cavity in the rock face <br />and is not currently being utilized as part of the prospecting operation. <br />A review of the NOI file found that no permanent structures were to be placed on-site. The Division considers <br />the plywood structure at the upper portal to be a permanent man-made structure. In addition, the NO[ states <br />that the portals would be safeguarded with closures which meet the Inactive Mine Reclamation Program's <br />design specifications, including tamper proof locks. The existing closure at the upper portal does not conform <br />to the approved NOI. Additional surface disturbance including fencing and the second closure adjacent to the <br />upper portal are not currently accounted for in the NOI. The deviations from the approved NOI have been <br />cited as a problem and will require the operator to submit a modification to the NOI to address the changes. <br />Please see the first page of this report for additional information. <br />The anniversary date for the NOI is February 13, 2015. As of the time of the inspection, the Operator had not <br />submitted the required annual report or annual fee. A copy of the past -due annual report was hand -delivered <br />to the Operator. <br />The Division currently holds a financial warranty in the amount of $11,426.00. The financial warranty amount <br />will be reevaluated upon submittal of the NOI Modification. <br />This concluded the inspection. <br />Page 2 of 5 <br />
