purposes of this Section, "Affiliate" means any entity controlling, controlled by or under <br />common control with Lessee. Any assignment or sublease in violation of this Section <br />shall be void. Lessor's rights hereunder shall be freely assignable or subject to sublease <br />without Lessee's consent. <br />. 26. Site Access and Maintenance. Lessee shall be responsible for maintenance of the access <br />road(s) leading to and within Lessor's Property to the site of Sand and Gravel operations. <br />Lessee shall be responsible for fencing or otherwise providing security for Lessee's <br />Property, and shall control all gates and locks necessary for access to Lessee's Property <br />for purposes of its operations hereunder. Lessee shall not be deemed an insurer or <br />guarantor of the safety or security of Lessor's Property or to have a fiduciary relationship <br />with Lessor. <br />27. Si na e. Lessee shall have the right to erect signage, conforming to existing code, to <br />identify and otherwise advertise its sand and gravel operation. Said location, design and <br />size of signage shall be selected at the sole discretion of Lessee. <br />28. Disclosure. Lessor shall provide Lessee with written copies of any and all documentation <br />that pertains to the operation and permitting of the sand and gravel operation. That <br />documentation shall include, but not be limited to, any and all access permits, mining <br />permits, land use permits, storm water permits and reclamation permits. It shall also <br />include copies of any previously issued, if any, MSHA violations, environmental <br />violations and correspondence with the Colorado Division of Minerals and Geology. <br />29. Notice. Notices of default or of cancellation or termination of this Lease and all other <br />notices or payments required or permitted hereunder shall be given in wri ting by personal <br />delivery or by registered or certified mail, postage prepaid, addressed to the parties as <br />follows: <br />If to Lessor: <br />995 3237 Highway 550 <br />Durango, Colorado 81301 <br />If to Lessee: <br />Crossfire Aggregate Services, LLC <br />820 Airport Road <br />Durango, CO 81301 <br />Either party may, by written notice given to the other party in the foregoing manner, change such <br />party's address for notice from time to time during the term thereof. <br />30. No Partnership. Nothing contained in this Lease is intended to create any partnership, <br />joint venture or association between Lessor and Lessee or in any way to make Lessor a <br />co- principal with Lessee with respect to the Leased Premises and any inferences to the <br />contrary are hereby expressly negated. Lessee shall have the right to advertise, and <br />
