b. A non - exclusive right of access (Easement) to and from and ingress <br />and /or egress on, over and across Lessor's Property to and from the <br />public road know known as County Road 213 to the Leased Premises. <br />C. The lease, the easement and other appurtenant rights described in <br />Paragraphs a & b above are collectively referred to herein as part of <br />the Leased Premises. <br />d. Exhibit A, shall include a formal survey, as prepared by a licensed <br />surveyor that depicts the outer boundary of the Leased Premises and <br />the areas within such that will be mined in succession ( "Mining <br />Plan "). Said Mining Plan shall identify ten (10) "lots" to be mined in <br />succession. Upon execution of this Lease, and Exhibit A hereto and <br />incorporated by reference, the Lessor will have accepted said Mining <br />Plan in substance and content and will have no right to further direct <br />the Lessee's operations, whatsoever. <br />3. Term and Option to Extend. Unless sooner terminated as herein provided, the term of <br />this Lease shall be for five (5) years, commencing as of the Effective Date (the "Initial <br />Term "). At the expiration of the Initial Term, this Lease shall automatically expire <br />unless the term is extended pursuant to the terms hereof. Provided Lessee is not in <br />material default hereunder, and provided Lessor and Lessee reach agreement as to a <br />Production Royalty rate for extension of the term, Lessee may, at its sole discretion, <br />chose to extend the term of this Lease for up to three (3) additional terms of ten (10) <br />years each, beyond the Initial Term, on the same terms and conditions as during the <br />Initial Term, by giving Lessor written notice of its intent to extend at least ninety (90) <br />days prior to the end of the Initial Term. Nothing contained in the Lease shall preclude <br />or prohibit the parties from negotiating a further or additional lease for the Leased <br />Premises. (The Initial Term and any extensions obtained pursuant to this Section are <br />referred to collectively as the "Term" of this Lease. <br />4. Termination. <br />a. Lessor shall have the right at Lessor's option to terminate this Lease if <br />Lessee fails to perform any of its obligations hereunder as follows: <br />i. If Lessee fails to pay when due any amounts to be paid hereunder, <br />Lessor may at Lessor's option give Lessee written notice of such <br />failure and Lessee shall have fifteen (15) days from the date it <br />receives notice to pay the amounts owed to Lessor. If Lessee fails <br />to pay the past due amounts to Lessor within the fifteen (15) day <br />period, Lessor may at Lessor's option declare Lessee in default and <br />terminate this Lease. <br />
