NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision <br />Application No. 3 (TR -3) for the Fruita Loadout (Permit No. C- 2010 -088), submitted by CAM - <br />Colorado, LLC (CAM). CAM proposes to use incremental bonding at the Fruita Loadout in <br />accordance with Rules 3.02.1(5)(b) and (6) and has requested a bond reduction in accordance with <br />Rule 3.02.2(5). Pursuant to Rule 3.02.2(3), this proposal would allow the operator to post the <br />minimum statutorily required bond of $10,000.00. A minimum of 30 days prior to the initiation of <br />any disturbance at the site, CAM would post the appropriate bond for that disturbance increment, as <br />set forth in the permit application package. Although the bond liability at the Fruita Loadout will <br />remain at $1,624,926.00, approval of this revision will allow CAM to reduce their bond held by <br />$1,614,926.00. There are no proposed changes to the Loadout's permitted, affected or disturbed <br />acreages. <br />The Fruita Loadout is a coal mine loadout located in Mesa County, approximately 3 miles NW of <br />Fruita. Coal interest is private, and the surface affected is private land. The permit area <br />encompasses approximately 208.60 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101, et seq., <br />C.R.S., and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the <br />Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 <br />Sherman Street, Denver, Colorado 80203. Persons with an interest that may be adversely affected <br />by the proposed decision may request a formal hearing before the Mined Land Reclamation Board <br />on the proposed decision. Such request must be made within thirty (30) days of the initial <br />publication of this notice, must be in writing, and must state with reasonable specificity the reasons <br />for the request and the objections to the proposed decision. <br />
