(Maisie) entered a Mining Lease to <br />re -open and operate the Capital Prize Mine in Georgetown, Colorado. The owner and <br />landlord of the Capital Prize Mine was represented by Mr. Kent Sterett. Subsequent to <br />executing the lease, on March 25, 2014 Maisie filed with DRMS its application for <br />Notice of Intent (NOI) to Conduct Prospecting Operations for Hard Rock/Metal Mines. <br />Maisie was notified by DMRS that the application was approved on May 19, 2014. <br />Maisie's initial NOI application stated: <br />Capital Prize Mine is an existing mine. The portal for the main tunnel was <br />constructed in 1905. The portal will not be disturbed. There will be no surface <br />disturbances such as excavations or ponds. Activity in the mine will consist of <br />clearing blockages and spreading the material from the blockages to available <br />sites in the mine. The need for reclamation is not anticipated. (Form 2, W.10) <br />It was suggested at the time of submittal that rather than stating zero surface acres would <br />be disturbed, a more timely review of the application would occur if the application <br />indicated a nominal acre may be disturbed. Therefore an environmental bond of $2,000 <br />was posted. <br />Actions by the landlord prevented Maisie from the opportunity to prospect or exercise its <br />rights as stated in provisions of the Mining Lease. Thus, no prospecting activity was <br />conducted and no surface disturbances were created. <br />Additionally, the landlord prevented Maisie from approaching Georgetown officials to <br />address land -use and zoning requirements. Maisie will reapply for an NOI in the event <br />issues with the landlord and town can be adequately addressed. <br />phone: (303) 771 -8635 fax.
