(Tri- State) is submitting the <br />enclosed "Application Form for a Revision to a Coal Mining and Reclamation Permit" for a <br />minor revision application on behalf of the Western Fuels- Colorado, A Limited Liability <br />Company (WFC) New Horizon Mine. Tri-State is the parent company of WFC. The New <br />Horizon Mine operates under Division of Reclamation, Mining and Safety (DRMS) Permit No. <br />C- 1981 -008. <br />This minor revision application is being submitted per a landowners' request that the <br />Bench 1 base be removed from the northern end of the BB Detour Road, and it will be stockpiled <br />adjacent to Pond 011. This stockpiled material will be utilized to reclaim Pond 011. The <br />landowner has also requested that the northern 300 feet of the BB Detour Road not receive <br />topsoil until such time that the adjacent Pond 011 is reclaimed. <br />Per telephone conversations between Mr. Tony Tennyson and Mr. Brock Bowles, it was <br />discussed and determined that the area proposed under this minor revision will be subject to the <br />bond requirements contained under Rule 3.06. This area will be exempt from the extended <br />liability period of Rule 3.02.3(2). <br />Also included with this minor revision is a revision application form, a change of index <br />sheet to ease incorporation into the permit document, and a signed letter by the landowner <br />requesting the items noted above.
