EXHIBIT C <br />EXCHANGE APPROVAL TERMS <br />From: Martellaro - DNR, Alan r niailto :alan.martellaronstate.co.usl <br />Sent: Thursday, March 05, 2015 11:43 AM <br />To: George Fosha <br />Cc: Bill Thompson - DNR; Neal Misbach - DNR; Kyle Whitaker <br />Subject: Re: Administrative Exchange <br />George, <br />Thank you for your request for an administrative exchange for construction water for the <br />Highway 9 improvement project. The exchange is for 16.5AF of Wolford Mountain Reservoir <br />storage to be exchanged from the confluence of the Blue and Colorado Rivers upstream on the <br />Blue River to a temporary pump on the Blue River, called the Blue Valley Ranch Gravel Pit <br />Supply Pipeline. The location of the temporary pump is in the SW 1/4 of the SE1/4 of section 16, <br />township 1N, range 80W of the 6th PM. At a point 2,445 feet from the east section line and 630 <br />feet from the south section line of said section 16. The amount to be pumped will be between <br />0.1 lcfs to 0.22 cfs. Diversions at the temporary pump will be 100% consumed and thus <br />replacement supply delivered to the exchange reach will be 1:1 for the amount diverted. <br />Together with the terms and conditions in your request for the administrative exchange attached <br />to an email dated March 4, 2015, the exchange is approved for the proposed months of April, <br />May and June of 2015 with the following conditions: \ <br />1) Submital of an electronic copy of the contract with the Colorado River Water Conservation <br />District prior to operation of the exchange. The contract must be for the amount to be exchanged <br />plus transit losses from the outlet of Wolford Mountain Reservoir to the confluence of the <br />Colorado River. <br />2) Notice of first date of use and any change in the timing of operation of the exchange as <br />approved must be pfovided prior to operation to Water Commissioner- Bill Thompson and my <br />office. <br />3) The exchange will be administered, as an unadjudicated water right, and therefore junior to all <br />prior vested rights, included adjudicated exchanges, on the Blue River below_ Green Mountain <br />Reservoir. <br />4) I do not.anticipate a call by any intervening water rights, but should injury occur the exchange <br />will be curtailed immediately. <br />If you have. any questions, or if you need to modify the administrative exchange to increase the <br />period of operation and/or the amount (e.g. contract with USBR for Green Mountain not <br />modified), do not hesitate to call. <br />2104395,3 <br />
