Martin <br />Marietta <br />April 6, 2015 <br />Mr. John Graves <br />6324 S County Road 3 <br />Fort Collins, CO 80528 <br />RE: Reclamation of your property <br />Dear Mr. Graves: <br />Julie Mikulas <br />Land Manager <br />This letter is being sent as follow -up to our phone and on -site conversations over reclamation of your <br />property. You have previously stated that when you bought the property south of the Greeley #2 Canal <br />in the 1970s, you had a verbal agreement with the seller that they would do some reclamation work for <br />you when M- 1979 -191 Three Bells Pit was reclaimed. You have requested that we do the following: <br />1) Re -grade your property so that it slopes to the south away from the channel <br />2) Bring in additional topsoil to plate the entire area with 6" of topsoil <br />3) Spread the two existing topsoil piles on your property <br />4) Remove a section of road base placed on your property that was going to be used for a haul road <br />to get to a crushing area on your property that never got set up. <br />The ownership of the property under M- 1979 -191 has changed ownership 5 or 6 times and your verbal <br />agreements has never been documented as a future liability. Martin Marietta does not own the property, <br />we only lease it. The DRMS permit has also gone through the succession of operator process several <br />times. Martin Marietta assumed responsibility for the permit as it was documented in 2011. We are not <br />responsible for changes that have occurred in the permit over the 30 years prior or mining activities that <br />happened pre -law. <br />That being said, we would still like to be a good neighbor and have reviewed each of your requests. I will <br />address each one individually: <br />1) Re- grading of your property requires surveying and documenting where easement, pipes, culverts <br />and utilities occur. It is an earthmoving project that requires more than just moving a little bit of <br />dirt around. Martin Marietta is not able to take on that expense and time at their cost. <br />2) Per DRMS requirements, we must first use the topsoil within the permit to reclaim the permit <br />area. If we can show that there is excess topsoil, it can then be sold and moved off site. We do <br />not have excess topsoil on our site to be able to spread 6" of topsoil across yours. <br />3) The smaller topsoil pile sitting next to your wetlands, we cannot move. The ground is too soft and <br />we run the risk of sinking our dozer or pushing material into the wetland. The second pile we will <br />push to the west for you.
