PERMIT #: M- 1986 -079 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: April 14, 2015 <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM/POSSIBLE VIOLATION: Problem: The mine identification sign was not posted at the entrance <br />the mine site. This is a problem for failure to post a mine identification sign as required by Section 3.1.12(1) <br />the Rules. <br />CORRECTIVE ACTIONS: The Operator shall, at the entrance of the mine site, post a sign which shall <br />clearly visible from the access road with the following: the name of the Operator, a statement that a reclamati <br />permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and the perr <br />number. The Operator shall submit photo documentation that a proper sign has been posted by the correcti <br />action date. <br />CORRECTIVE ACTION DUE DATE: 6/29/2015 <br />OBSERVATIONS <br />This normal routine monitoring inspection was conducted by Tyler O'Donnell of the Division of Reclamation, <br />Mining and Safety (Division/DRMS). Mann Resources LLC, the Operator, was notified about the inspection. <br />The representative for Mann Resources could not attend the scheduled inspection. Steve O'Brian with <br />Environment, Inc., the consultant representing Mann Resources LLC, was present during the inspection. <br />The M & G Pit is located in Adams County approximately 7.5 miles north - northeast of Commerce City <br />Colorado. The M & G Pit is a 70.5 -acre 112c Construction Materials Reclamation Permit. The primary <br />commodity mined at the site was sand and gravel. The permit was issued in August of 1988. The approved <br />post- mining land use is wildlife habitat. The mine site is surrounded by the following land uses: <br />industrial /commercial, residential, agricultural, and mining. <br />During the inspection, the sky was clear and the ground was dry with the exception of the exposed groundwater <br />pond. At the present time it appears that the mining operation has affected the entire permitted site. It appears <br />that no mining activity is occurring, the Operator is in the process of completing reclamation. The Operator has <br />backfilled portions of the exposed groundwater pond. Dumb trucks and a front -end loader were observed <br />during the inspection. The trucks were dumping clean fill dirt along the shoreline and the loader was placing <br />the soil in to the lake. It appears that the pit sees frequent truck traffic to place fill in the exposed groundwater <br />pond. The Operator has also been placing fill along the northern and eastern ends of the affected lands. The fill <br />being placed in the northern and eastern areas is being place to raise the land surface to an elevation desired by <br />the landowner. The elevation desired by the landowner is well above the static groundwater elevation. The <br />Operator is filling the site to this elevation for a future possible land use projects. <br />Backfilling and Gradiniz: <br />The Operator has imported a large volume of inert fill. The Operator has backfilled the majority of the northern <br />and eastern portions of the site to the landowner's desired elevation. The Division believes there is adequate <br />imported material on -site to backfill all of the exposed groundwater to the minimum 2 -feet above static <br />groundwater elevation. <br />Financial Warranty: <br />The current amount of financial warranty the Operator has on deposit with the State is $9,700. Based on the <br />observations made during this inspection and compliance with the Division's April 30, 2010 letter regarding <br />Mining Operations with Exposed Groundwater (enclosed), the cost to reclaim the site was estimated to be <br />$283,455.51 (see attached reclamation cost estimate). The new required financial warranty amount was <br />calculated based on the cost to backfill the pond and seed the site with the approved seed mix. The new <br />required financial warranty is $283,500.00, resulting in a current deficit of financial warranty on deposit with <br />Page 2 of 8 <br />
