Schure <br />12826 County Road 37 <br />Sterling, CO 80751 <br />Re: Dollerschell Pit, Permit No. M- 1986 - 074,112 Conversion Application Adequacy Letter (CN -01) <br />Dear Mr. Schure, <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of your permit Conversion <br />Application (CN -01) for the Dollerschell Pit, File No. M- 1986 -074, and submits the following comments. Please <br />be aware that the Board Order of Violation No. MV- 2014 -040 imposed the corrective action that this conversion <br />application must be approved within 180 days of the effective date of the Order (mailed on December 5, 2014). <br />Following the Board Order, the Division is required to make an approval or denial decision no later than <br />June 3, 2015; therefore, a response to the following adequacy review concerns should be submitted to the <br />Division as soon as possible. In order to allow the Division adequate time to review your responses to the <br />adequacy issues, please submit your adequacy responses to the Division no later than one week prior to the <br />decision date (May 27, 2015). <br />The review consisted of comparing the application content with specific requirements of Rules 1, 3, 6.1, 6.2, and <br />6.4 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br />Construction Materials. Any inadequacies are identified under the respective exhibit. <br />GENERAL <br />1. As required by Rule 1.6.2(d) and 1.6.5(2), please submit proof of publication in a newspaper of general <br />circulation in the locality of the proposed mining operation. <br />2. As required by Rule 1.6.2(e), please submit proof of the notice to all owners of record of surface and mineral <br />rights of the affected land and the owners of record of all land surface within 200 feet of the boundary of the <br />affected land; this includes all easement holders located on the affected land and within 200 feet of the <br />boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of <br />personal service. <br />3. The Division received comments from the Division of Water Resources and History Colorado. The letters are <br />attached for review. Please acknowledge the letters, address any comments within the letters, and make <br />changes to the application as necessary. <br />APPLICATION FORM <br />4. Throughout the application form, the Applicant/Operator is listed as Kym Schure while the original 110c <br />permit is held by Kym A. Schure. Please submit a signed statement listing Kym Schure and Kym A.
