(Tri- State) has received your <br />completeness review letter for TR -68, dated April 2, 2015 and provides the following response on behalf <br />of Western Fuels - Colorado, A Limited Liability Company (WFC) New Horizon Mine. <br />4.05.2 - Water Quality Standards and Effluent Limitations <br />1. Sediment control measures were not addressed for the Calamity Draw pump station. All other <br />structures proposed for the stream buffer zone variance in TR -68 meet the requirements of Rule <br />4.05.2(4) and do not need sediment control measures. <br />Response: WFC has provided a SEDCAD sedimentology demonstration to show that the <br />undisturbed vegetation surrounding the Calamity Draw pump station acts as a grass filter and that <br />sedimentation ponds or other treatment facilities are not necessary for the drainage to meet the <br />effluent limitations of 4.05.2. In accordance with Rule 4.05.2(3)(a), this demonstration meets the <br />criteria for an exemption from the requirements of 4.05.2. <br />Included in this completeness response package is revised material in response to your <br />completeness comments, and a change sheet index to assist with incorporating the revised material into <br />the permit document.
