Box 10 <br />Nucla, CO 81424 <br />Re: Citizen Comment Letter of April 15, 2015 <br />New Horizon Mine, Permit No. C- 1981 -008 <br />Dear Mr. Staats: <br />Thank you for your comment letter dated April 15, 2015. I have forwarded your letter to Western Fuels - <br />Colorado (WFC). <br />In your letter you expressed your belief that 3.5 feet of Barx Sandy Loam (2nd lift) was not replaced on your <br />field and the soil does not comply with what the permit requires for your property. You are requesting that test <br />holes be dug to confirm there is 3.5 feet of Barx Sandy Loam and .8 feet of topsoil. Further, if the soil does not <br />meet the requirements of the permit then you are requesting that WFC repair your field to the standards of the <br />permit. <br />In our March meeting, we discussed the addition of 0.8 feet of topsoil to your field and an August 30, 1995 <br />letter from the Division confirms that WFC will return this soil. Your concern that 3.5 feet of Barx Sandy <br />Loam may not have been replaced is a different issue and I will do some additional research to look into this <br />matter. As part of my understanding of this issue, I would like to schedule another meeting with you and WFC <br />to walk through your field for a visual inspection.
