receiving stream standard for selenium has not been exceeded at any of the downstream monitoring <br />sties. <br />Water pollution is not occurring from the SL -3 bond release are of the Peabody Sage Creek Mine <br />and, based on a review of the monitoring data and on- the - ground observations, there is no potential <br />for future water pollution from the bond release area. Water quality at the alluvial Ground Water <br />Point of Compliance well is within the prescribed limits. Based on the foregoing observations <br />regarding hydrologic impacts, the Division finds PSCM has minimized disturbance of the hydrologic <br />balance in the bond release area and adjacent areas, and prevented material damage outside the <br />permit area. <br />On Tuesday, March 31, 2015, the Division met with Erin Scott, Kathy Rosow and Geneva Brion of <br />CDPHE's Water Quality Control Division (WQCD). During the meeting, the Peabody Sage Creek <br />Mine's SL -3 Phase III Bond Release was discussed. <br />Subsequent to the meeting, an email from the Clean Water Permit Unit of the WQCD, received by <br />the Division on April 6, 2015, stated that the Clean Water Permits Section of the Clean Water <br />Program of the WQCD has no site - specific concerns with the Division's SL -03 bond release of the <br />Peabody Sage Creek Mine. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that Peabody Sage Creek Mining, LLC has successfully completed all surface coal <br />mining reclamation operations in accordance with the approved reclamation plan and met all <br />requirements of the Act and the Rules. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Peabody Sage Creek Mining, LLC's <br />request for a Phase III bond release for the Peabody Sage Creek Mine. This proposed decision will <br />release the applicant from liability from all reclamation liability associated with 1,026 acres of the <br />1697.60 interim program and permanent program acres previously permitted under the Seneca II Mine <br />permit. <br />Currently, the acreage approved to be disturbed at the Peabody Sage Creek Mine is 1697.60 interim <br />program and permanent program acres previously permitted under the Seneca II Mine permit, 79.56 <br />Phase III - released acres approved to be re- disturbed under the Peabody Sage Creek Mine permit as new <br />permanent program acres, and 66.86 new permanent program acres approved to be disturbed under the <br />Peabody Sage Creek Mine permit, for a total of 1844.02 disturbed area acres. Upon final approval of <br />SL -03, the remaining Phase I, II, and III liabilities will be as shown in Table 6. <br />
