Mr. Miller <br />Page 2 <br />April 24, 2015 <br />6. The Applicant has stated the proposed seed mix is tentative and may change based upon <br />USFS requirements. Please note that any change to the proposed seed mix will require a <br />modification of the NOI. <br />7. The Applicant has indicated the prospecting pit will have safety fencing erected around the <br />perimeter. Please commit to keeping the safety fencing in place for the duration of the <br />prospecting operation. <br />8.. Please provide a map that identifies the proposed prospecting site or activity areas involving <br />surface disturbance including but not limited to topsoil stockpiles, overburden stockpiles, <br />access roads and equipment storage. <br />9. The Applicant has stated there is a dozer cut between the access road and the prospecting <br />location. Please specify the dimensions of the dozer cut and clarify if this area will be <br />reclaimed. <br />10. Please provide the Division with any photographs of the existing conditions of the site. Upon <br />completion of reclamation and request for bond release, the Division may consider the photos <br />as evidence of adequate reclamation. <br />11. The applicant has indicated approximately 6 inches of topsoil will be salvaged and <br />stockpiled. If 6 inches of topsoil is stripped from the trench location, then approximately 33 <br />cubic yards of topsoil will be stockpiled. However, the POO indicates that 100 cubic yards of <br />topsoil will be replaced during final reclamation. Please clarify this discrepancy. <br />Be advised that if these items have not been addressed within 60 days of the date of this letter <br />(June 23, 2015), the Division may terminate the NOI application in accordance with Rule <br />5.13(c) of the Hard Rock Rules. <br />Please remember to designate as appropriate those materials in the application that you desire to <br />be made confidential versus those to be made public.
