Highway 385 <br />Burlington, CO 80807 <br />Re: Schlosser Pit 1, Permit No. M- 2014 - 061,112 Construction Materials Reclamation Permit Application, <br />Additional Adequacy Letter <br />Dear Mr. Schlosser, <br />The Division of Reclamation, Mining and Safety (Division) has received your Adequacy Issue Response letter for <br />the Schlosser Incorporated 112c permit application for the Schlosser Pit 1, File No. M- 2014 -061, and submits the <br />following additional comments. The Division is required to make an approval or denial decision no later <br />than May 1, 2015; therefore, a response to the additional adequacy review concerns should be submitted to <br />the Division as soon as possible. In order to allow the Division adequate time to review your responses to any <br />adequacy issues, please submit your adequacy responses to the Division no later April 30, 2015. <br />EXHIBIT C - Pre - mining and Mining Plan Map(s) of Affected Lands (Rule 6.4.3): <br />26. Please update the Exhibit C - Mine Plan Map, provided in the response letter, to show the owner's name <br />and locations for the fences described in the response to item 23. Additionally, please correct the labeling <br />PHASE ONE AREA (20 ACRES) and PHASE TWO AREA (30 ACRES) on the Mine Plan Map provided; <br />these appear to have been switched from what the mining plan narrative describes. Finally, please correct <br />the alluvial deposit description Map as well; the depth of topsoil appears to be different than described in <br />mining plan and reclamation plan narratives. <br />EXHIBIT D - Mining Plan (Rule 6.4.4): <br />27. Please provided information on if the intent of the operation is to abandon the inactive water well, owned by <br />Schlosser Inc. that is located within the Phase One area, and mine through its location or mine around the <br />well, leaving it intact. <br />28. The Operator stated that no encountering of groundwater is expected during the mining operation. Please <br />commit to keeping the mining operations a minimum of two feet above groundwater level if groundwater is <br />encountered. <br />EXHIBIT E - Reclamation Plan (Rule 6.4.5): <br />The Reclamation Plan states that the area included in Phase Two will not be used until all of the area in <br />Phase One is reclaimed. Please note that it may take several years to fully reclaim and release the <br />reclamation responsibility for the Phase One area after mining has ceased in Phase One. If this length of <br />time is not feasible for the Operator, the Division may process an Operator's Request for Surety Reduction <br />on the Phase One area after overburden and topsoil replacement has occurred.
