PERMIT #: M -1979 -165 <br />INSPECTOR'S INITLUS: TOD <br />INSPECTION DATE: December 19, 2014 <br />OBSERVATIONS <br />This normal routine monitoring inspection was conducted by Tyler O'Donnell of the Division of Reclamation, <br />Mining and Safety (DRMS). Albert Frei & Sons Inc., the Operator, was represented by Ben Frei and Albert <br />Frei Jr. during the inspection. Steve O'Brian with Environment, Inc., the consultant representing Albert Frei & <br />Sons, was also present during the inspection. <br />The Frei Pit No. 3 is located in Adams County approximately 1 mile north of Commerce City, Colorado, just <br />east of I -76. The Frei Pit No. 3 is a 1.87 -acre 112c Construction Materials Reclamation Permit, which was <br />issued in 1979. The majority of the pit was released with the approval of Acreage Release No. 1 (AR -01) in <br />August of 2009. The approved post- mining land use Industrial/Commercial. <br />During the inspection, the sky was clear and the ground was dry. There was a large stockpile of imported fill, <br />this stockpile was functioning as a sight berm. The Operator was currently processing material and removing <br />the sight berm located between the former Fernald pit (DRMS File No. M- 1977 -011) and I -76. The material in <br />the sight berm was being screened prior to placing the material throughout the Fernald Pit to raise the land <br />surface elevation. It appears that the Operator was screening and removing material larger than approximately <br />6 inches in diameter. No problems or violations were observed during the inspection. <br />Backfilling and Grading_ <br />The Operator has backfilled the majority of the site to the desired elevation. The northern and eastern slopes <br />were graded to 2H:1 V or flatter. <br />Financial Warranty: <br />The current amount of financial warranty the Operator has on deposit with the State is $2,836.00. <br />The reclamation cost estimate for this pit was updated with this inspection. It was determined that the current <br />financial warranty amount is adequate. <br />Hydrologic Balance: <br />The Operator had backfilled all of the exposed groundwater. There was no evidence of excessive erosion. <br />There appeared to be no significant impacts to the prevailing hydrologic balance. <br />Gen. Compliance With Mine Plan: <br />The operation appeared to be following the approved mine plan. All mining related activity appeared to be <br />within the approved boundary. The approved reclamation plan requires the Operator to backfill the pit to an <br />elevation to match the adjacent rail line and the Fernald Pit to the south. The backfill slopes shall be graded to <br />2H:1 V or flatter. <br />Roads: <br />The access road was stable, well maintained and in good condition. <br />Recl Plan/Cow: <br />The Operator has successfully backfilled the exposed groundwater. The Operator has successfully backfilled <br />and graded slopes to an approximate slope of 2H:1 V or flatter, creating a stable land surface. , <br />Revegetation: <br />There was plant growth on the stockpiles /sight berm and through the disturbed area. Some of this growth in the <br />disturbed area appeared to be volunteer vegetation, comprised of grasses, trees, a few annual weeds and noxious <br />weeds. The Operator will need to treat all annual weeds and noxious weeds. <br />Page 2 of 5 <br />
