failure to minimize disturbance to the prevailing hydrologic balance. The Division <br />mailed the May 27, 2014 inspection repori to the Operator. <br />19. On October 31, 2014, the Division inspected the Hazeltine Mine and <br />observed the Complainant Property. Connie Davis, representing the Operator, and <br />the Operator's contractor, Nick Silbaugh, attended the inspection. Mr. Orr and <br />Stevan O'Brian, of Environment, Inc., representing Mr. Orr, attended the <br />inspection. At the Complainant Property, the Division observed that portions of the <br />land surface remained submerged, including the northwest corner of the <br />Complainant Property. The Division estimated that the water level on the <br />Complainant Property had dropped approximately one (1) foot since the March 27, <br />2014 inspection. The Division estimated that the groundwater elevation in the <br />northwest corner of the Complainant Property had changed very little since the <br />March 27, 2014 inspection and that portions of the Complainant Property remained <br />covered by up'to two (2) feet of water. At the Hazeltine Mine site, the Division <br />observed `eater flowing through the Agridrain. <br />20. The Division stated in the October 31, 2014 inspection report that the <br />Operator indicated in several annual reports that the monitoring toring wells were <br />inaccessible due to saturated surface conditions. <br />21. The Division concluded that the saturated conditions at the <br />Complainant Property and the increases in alluvial groundwater levels in the <br />monitoring wells are the result of alluvial groundwater mounding against the slurry <br />wall. As a result, the Division cited the mounding of alluvial groundwater on the <br />outside of the Hazeltine Mine as a possible violation. <br />22. The October 31, 2014 inspection report required the Operator to, by <br />November 25, 2014, submit (in the form of either a Technical Revision or a permit <br />amendment) a groundwater mounding mitigation plan to include: (a) a detailed <br />description of the measures the Operator will take to reduce groundwater mounding <br />outside the Hazeltine Mine to a level that eliminates flooding on the Complainant <br />Property; (b) a schedule for implementing the mitigation plan; and (c) sufficient <br />information for the Division to estimate the cost of implementing the mitigation <br />plan. The Division mailed the October 31, 2014 inspection report to the Operator. <br />23. The Operator failed to implement the corrective actions imposed by the <br />October 31, 2014 inspection report. The Operator was notified of the hearing to <br />consider the violations set forth in the October 31, 2014 inspection report. <br />24. On February 3, 2015, the Division mailed a Reason to Believe a <br />Violation Exists letter to the Operator, informing the Operator of the possible <br />violations for failing to minimize the disturbance to the prevailing hydrologic <br />Aggregate Industries — WCR, Inc. <br />M -2004 -031 <br />MV -2015 -003 5 <br />
