Since there is existing historic water then exits the mine, we have to be extremely careful since a
discharge permit could put the existing water out of compliance, creating a monumental treatment
problem. For this reason, we have submitted a PEL request to CDPHE and we have paid them to do
the analysis.
The PEL document issued by CDPHE will state what the permit limits would be if a permit was ever
issued. We will then compare these limits to actual water tests we have conducted on the portal
discharge and then decide if it is worth pursuing a discharge permit or if the project will be abandoned.
For this reason, we ask that the NOI be held in review until this work can be completed. Keep in mind
that we are doing all of this to ensure we comply with what the CDPHE ruled for the NOI.
Thanks.
Sincerely,
Greg Lewicki, P.
