• COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />17 April 2015 <br />Tom Bird <br />Manager of Coal Services <br />GCC Energy, LLC <br />6473 County Road 120 <br />Hesperus, CO 81326 <br />Re: King Coal Mine — Permit No. C- 1981 -035 <br />Review of 2014 Annual Reclamation Report <br />Dear Mr. Bird: <br />The Division has conducted a review of the Annual Reclamation Report (ARR) submitted for <br />calendar year 2014 at the King Coal Mine. The ARR has been evaluated with respect to the <br />requirements set forth in Rule 2.04.13 and commitments made by GCC in Section 2.04.13 of the <br />permit. We have also compared the 2014 ARR with reports submitted in previous years. <br />Because the King Coal Mine consists of two geographically separate surface facility areas (King <br />I and King II), GCC Energy, LLC has opted to submit a separate CDRMS ARR form for each <br />site. King I was in operation prior to SMCRA; ARRs for this mine date back to 1991. The King <br />II area was permitted in 2006, under PR -8, and ARRs have been submitted since 2007. <br />Underground mining at King I drew to a close in 2007, and active mining operations were <br />shifted to King IL 2008 was the first year for an ARR to be submitted for King II. <br />Rule 2.04.13 requires that an ARR be filed by February 15 for the previous calendar year, or <br />other such date as agreed on. Section 2.04.13 of the permit supersedes this requirement, with a <br />date of March 1. <br />The 2014 ARR was received via Email on 23- Feb -2015. <br />Rule 2.04.13 states that the ARR shall include, but not be limited to, text, discussion and maps. <br />Maps of the King I and King II disturbed areas accompanied the ARR forms for 2014. <br />The maps are presented at scales that do not incorporate the entire area of disturbance. <br />Please submit amended maps showing the full extent of the surface disturbance at <br />King I and King II, with a legend to include the symbol used to delineate disturbance. <br />No text or discussion was provided [see comment under (1) (b), below]. <br />2.04.13(1)(a) The name and address of the permittee (GCC Energy, LLC) and the permit <br />number (C- 1981 -035); <br />The forms included the required information. For King I, the county road address for <br />that facility was shown.
