(NWCC) <br />on April 10, 2015. The report covers the first quarter, 2015 monitoring period. The site was inspected on <br />March 31, 2015. The report appears to be in compliance with CDRMS Regulations 4.09.1(11) and <br />4.10.2(2), unless noted below. <br />The report was stamped by Brian Len a Colorado Registered Professional Engineer. The report was <br />received within two weeks after the inspection was conducted. According to the report, the upper haul <br />road to Areas 2, 3, and 4 of the refuse piles was not accessible during the inspection. Based on the report, <br />NWCC did not observe any signs of instability, structural weakness or hazardous conditions at the pile. <br />The underdrain construction was inspected and found to be incompliance with the plans and <br />specifications. Color photographs of the underdrain construction were included with the report. The <br />seepage area at the toe of the northeast end of the refuse pile expansion area was inspected. The seep was <br />flowing, no signs of washout, slumps or slope instabilities were observed. <br />Three piezometers (RW #1, 42 and 93) were monitored monthly during this quarter. The report indicates <br />refuse coal was being stockpiled and compacted at the time of the March 31, 2015 site inspection. No <br />compaction tests were taken by NWCC in the new Expansion Area of the refuse pile this quarter. The <br />Foidel Creek Mine permit requires regular compaction testing for the quarterly refuse pile inspection <br />report.
