premises. <br />10.3 - Recognizing the above potential conflicts, the parties agree as follows: <br />a. Lessee's continuing operation under the terms of this Lease shall take precedence over <br />Lessor's goal of utilizing the reclaimed land for other purposes. <br />b. Lessee agrees to complete reclamation of portions of the leased premises in excess of <br />the acreage Lessee deems reasonably necessary to retain for its continuing operations <br />within thirty (3 0) days after said land is exhausted of gravel to the depth provided for in <br />The mining plan. Within ten (10) days after completion of reclamation, Lessee agrees to <br />execute a partial release releasing said parcel from this Lease, subject, however, to any <br />reservation of easements Lessee deems necessary to its continuing operations hereunder. <br />c. Lessor agrees to utilize any land released hereunder in a manner compatible with <br />Lessee's continued ;Wining of the remainder of the leased premises. <br />11. MINING PERMIT <br />11.1 - Lessee agrees to obtain in its name a gravel mining permit obtained from the <br />Colorado Division of Minerals and Geology and post any required bond. Lessee also agrees to <br />obtain any approvals needed from Rio Blanco County in order to conduct its operations pursuant <br />to this Agreement. Lessor agrees to cooperate in the obtaining of all necessary approvals, <br />including but not limited to the re- zoning of the Leased Premises if necessary, to conduct <br />operations contemplated pursuant to this Agreement. <br />12. RIGHTS TO ADDITIONAL MINERALS <br />12.1- If any minerals as distinguished from sand, gravel, rock or dirt shall be recovered <br />on the Leased Premises, Lessor and/or Meal J. Dow and Anna Dow shall negotiate and agree <br />upon the allocation and distribution of the value of such materials. <br />13. WATER <br />13.1 - Lessor agrees to guarantee and provide to Lessee, during the term of this Lease, all <br />water needed on the Leased Premises for washing, dust control, or any other purpose related to <br />Lessee's operations as contemplated pursuant to this Agreement. <br />13. - Lessor's obligation is to provide water at the level of the irrigation ditch running <br />adjacent to the leased premises. In the event pumping is required, any cost of pumping shall be <br />borne by Lessee. <br />14. ACCESS <br />Page 6 of 10 <br />
