PERMIT #: M- 2015 -003 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: April 8, 2015 <br />OBSERVATIONS <br />This was a pre- operational inspection of the New Cache Agricultural Pond 1 site conducted by Peter Hays with <br />the Division of Reclamation, Mining and Safety (Division). Mr. Dale Trowbridge with The New Cache La Poudre <br />Irrigating Company was present during the inspection. <br />The 112c construction materials permit application was received by the Division on January 28, 2015. The <br />application was deemed complete on March 6, 2015. The decision due date is June 4, 2015. The Applicant <br />published public notice as required by Rule 1.6.2(d) for four consecutive weeks. The last notice was published <br />on April 10, 2015. The public comment for the application ends on April 30, 2015. No objections have been <br />received by the Division to date. The notice sign was observed during the inspection as required by Rule <br />1.6.2(b). The Division mailed the Applicant a copy of the adequacy review letter on April 13, 2015. <br />The site is located approximately 2 miles east of Greeley, CO. The current land use is pastureland. The <br />proposed permit boundary will encompass 16.2 acres with 13.0 acres disturbed by the creation of a 9.13 acre <br />agricultural pond. The project is estimated to create 125,000 cubic yards of waste material. The waste <br />material will be sold by the Applicant. Mining activity is estimated to begin in spring of 2015 and end prior to <br />spring 2016. The construction for the pond will consist of a nine (9) feet deep excavation with a perimeter <br />embankment ten (10) feet in height with 3H:1V interior and exterior slopes. Groundwater will not be <br />intercepted during the mining operation. The pond will be lined to create an agricultural pond suitable for <br />water storage. The permit boundary was delineated by survey lath and fences with the exception of the <br />shared entrance. <br />A shallow excavation, one (1) to three (3) feet in depth, was observed at the site during the inspection. The <br />excavation occurred prior to the Applicant being aware the excavation activity required a reclamation permit. <br />The disturbance was reported by the Applicant during a meeting with the Division on January 22, 2015. The <br />mining disturbance is not considered a problem by the Division, since it was reported by the Applicant and <br />mining activities stopped once the Applicant was aware of the need for a permit. <br />A stockpile of concrete was observed in the southwest corner of the site. The Applicant stated the concrete <br />was from the demolition of a lined ditch and would be removed from the property. <br />A mine sign as required by Rule 3.1.12 shall be posted at the entrance of the mine site with the following <br />information following approval of the permit by the Division; the name of the Operator, a statement that a <br />reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board, and <br />the permit number.
