Disturbance (Previously <br />Phase II Released) <br />New Proposed <br />0 <br />14.25 <br />14.25 <br />14.26 <br />14.26 <br />Disturbance (Revisions) <br />Submittal of Bond Release Application and Completeness Determination by the Division <br />The Division received PSCM's bond release application SL -03 on July 9, 2014. SL -03 initially <br />requested Phase III release of 1,028 acres of permanent program lands that that received Phase I bond <br />release under SL -01 and SL -04 for the Seneca II Mine (C- 1980 -005) and Phase II bond release under <br />SL -03 and SL -05 for the Seneca II Mine (C- 1980 -005). The number of acres was reduced to 1026 <br />during the review process. The application was found complete on July 31, 2014, after the Division <br />received proof of publication of the applicant's public notice. The completeness determination was <br />made in accordance with Section 3.03.2(1)(d). <br />PSCM submitted the bond release application following the procedures described in the Act and <br />Regulations. The application also utilized the Division's Guideline Regarding Selected Coal Mine <br />Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />PSCM published notice of the bond release application in the Steamboat Pilot & Today once weekly <br />for four consecutive weeks, beginning on June 29, 2014. PSCM also notified landowners within and <br />adjacent to the mine permit area, as well as other interested parties, of the application for bond <br />release, as required by section 3.03.2(1). The Division received no written comments, objections, or <br />requests for an informal conference regarding the bond release application. <br />Items Approved for Permanent Retention <br />Roads approved as permanent features for the Peabody Sage Creek Mine were approved under <br />Technical Revision No. 37 (TR -37) on May 2, 2005 for the Seneca II Mine and included with the <br />approval of C- 2009 -087. Roads include road(s) E1, C, F, South Road, and the South Road spur to <br />Pond 008 of the Seneca II Mine. The roads were deemed necessary to support the post mining land <br />use. <br />Small livestock/wildlife stock ponds have been approved as permanent structures on PSCM <br />reclaimed lands. These ponds are contained within lands transferred to PSCM from the Seneca II <br />Mine. The stock ponds within or immediately adjacent to the SL -03 Phase III area include T -4, T -8, <br />T16, T17, T26, T28, T29, T30, T31, and T35. The locations of these ponds are on Map 2, Phase III <br />Bond Release SL -3 Permanent Features Map, in the SL03 application. <br />Bond Release Inspection <br />The Division scheduled and conducted a bond release inspection on August 13 and 14, 2014.
