Exhibit N — Source of Legal Right to Enter <br />The owners of the affected land for the French drain installation are Bromley <br />District Water Providers L.L.C. (for the Pit 29 Property), Henderson Aggregates, <br />LTD, and Adams County. <br />In its conveyance of the Pit 29 Property to the current owner— Bromley District <br />Water Providers, L.L.0 — Brannan reserved the right to extract the sand and gravel <br />therein "in accordance with all applicable laws, rules and regulations, and the <br />terms and conditions of any bonds or permits issued or required in connection <br />therewith." See Deed attached hereto as Exhibit N -1. As a result, Brannan has the <br />authorization to install the French drain on the Pit 29 Property. <br />Brannan's source of legal authority to enter the Henderson Aggregate property is <br />demonstrated by the verbal authorization from Henderson Aggregate LTD which <br />is in the process of being memorialized in writing. <br />Brannan will obtain the necessary road crossing permit from Adams County. <br />
