PERMIT #: M -1998 -067 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: June 19, 2014 <br />OBSERVATIONS <br />This inspection was conducted as part of the regular monitoring program. Messrs. Joe and Matt Welte were <br />present for the inspection, representing the Operator (Summit Brick & Tile Co.). Mr. Phil Courtney was also <br />present, representing the State Land Board. This is a 112c clay mine. The mine was not operating at the time <br />of the inspection. <br />The Patton Clay Mine is accessed from Co Road 69, approximately seven miles northwest of Canon City. <br />Inspection: <br />A permit sign was posted near the site entrance (see Photo 1). The permit area boundaries are marked with <br />T -posts (see Photo 2). The highwall on the north end of the pit was benched and appeared stable (see Photo <br />3). Mining activity appeared to be relatively recent. The Operator indicated stormwater drains to sediment <br />traps in the pit (see Photo 4) which was dry at the time of the inspection. Mr. Welte stated the stormwater <br />management plan was filed in their office in Pueblo. The Operator representatives indicated blasting <br />operations are contracted out to LCI in Penrose and occur infrequently. <br />Area A is on the south end of the permit area. Mining activity in Area A was limited at the time of the <br />inspection (see Photo 5). <br />Reclamation activity: No reclamation activity had begun at the time of the inspection. A topsoil stockpile was <br />observed near the active pit area (see Photo 6). <br />Records: <br />• The total permitted area is 280 acres, with a phased maximum affected area of 20 acres. <br />• A blasting plan was received by the Division on July 22, 2002. <br />• A blasting plan was submitted to the Division on May 29, 2004 in response to requests from the <br />Division's May 28, 2004 inspection. <br />• Revisions: none <br />• The previous inspection was performed on 11/20/2009. No problems were cited. <br />• The anniversary date is January 13. Annual reports and fees are current through 2015. The 2015 <br />annual report indicated 5.0 acres had been affected. <br />• The post -mine land use is rangeland. <br />Current Stipulations: <br />1) Prior to conducting any blasting associated with the mining plan, the operator will submit a <br />Geotechnical Stability Exhibit in compliance with Rule 6.5(4) of the Construction Materials Rules and <br />Regulations of the Mined Land Reclamation board, specifically demonstrating that off -site areas will <br />not be adversely affected by blasting. A review of the file indicates a blasting plan was submitted on <br />7/22/2002. The Division's database has been updated to reflect Stipulation No. 1 has been complied <br />with. <br />2) Prior to conducting any mining in areas B,C,D,E,G, and H, the operator will submit an updated mining <br />plan map which clearly details the mining plan as per areas A and F of the current Mine Plan Map. <br />Page 2 of 6 <br />
