PUBLIC NOTICE
<br />Peabody Sage Creek Mining, LLC, 36600 CR 27, Hayden, CO 81639 -0250, ( CDRMS Permit No. C-
<br />2009 -087, approved June 8th, 2010) is requesting release of Phase III bond liability on 1,028 acres of
<br />reclaimed lands at the Peabody Sage Creek Mine (PSCM). A self -bond in the amount of
<br />$4,420,284.46 is currently in place, a portion of which is being requested for release as determined by
<br />the Colorado Division of Reclamation, Mining and Safety ( CDRMS). Surface mining and initial
<br />reclamation activities were performed under the Seneca Coal Company as part of the Seneca II Mine.
<br />A portion of these reclaimed areas were removed from the Seneca II permit and transferred to the
<br />PSCM permit as a part of the mining permit approval.
<br />The Phase III Bond Release Request is on reclaimed areas that have received Phase II bond release
<br />and where reclaimed vegetation has met success criteria, the approved post- mining land use has been
<br />achieved, and hydrology assessments have been successful. The requested areas were revegetated
<br />1977 through 1995 in accordance with CDRMS rules and regulations.
<br />The Peabody Sage Creek Mine is located approximately nine (9) miles southeast of Hayden, Colorado.
<br />The specific area to which this bond release request applies is included in portions of the following
<br />sections located within the permit area:

<br />Section 2 — Portions of L1, L2, SWNE, SENE, L3, L4, SWNW, SENW, NESW, NWSW, SWSW,
<br />SESW, NESE, NWSE, SWSE, and SESE
<br />Section 3 — Portions of NESE and SESE
<br />Section 11 — All of NENE, portions of NWNE, SWNE, SENE, NENW, SENW, NESE, NWSE
<br />Section 12 — Portions of NENW, all of NWNW, Portions of SENW, SWNW, NESW, NWSW,
<br />SWSW, SESW, NWSE, and SWSE
<br />All west of the 6th Principal Meridian; totaling 1,028 acres.
<br />The USGS 7.5 Minute Quadrangle Maps for Milner and Mt. Harris contain the described affected
<br />area. A copy of the bond release application is available for public inspection at the Hayden Public
<br />Library, 201 E. Jefferson Avenue, Hayden, Colorado 81639. Written comments or objections or
<br />requests for public hearing or informal conference concerning this application may be submitted to,
<br />and additional information obtained from, the Colorado Division of Reclamation, Mining and Safety,
<br />1313 Sherman Street, Room 215, Denver, Colorado 80203 -2273, (303) 866 -3567. Comments must be
<br />received within 30 days of the last publication of this notice or within 30 days of the onsite inspection,
