April 2, 2015 C- 1981- 012/New Elk Mine LDS <br />beneficial agreement could be reached. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />NECC planned to begin moving development waste to the RDA by mid -April. Haul trucks had been <br />serviced in readiness and staff (who are underground miners by trade) had been trained to use the haul trucks, <br />loaders and dozer by the surface specialists. The first pile to be moved is the temporary pile on the clean coal <br />stockpile pad. Mr Tokar had already ripped the front edge of the pile to make loading easier, and scraped the <br />access route across the pad back to bare ground to minimize the potential for spreading coal around the site. The <br />second pile to be moved is the temporary pile in the soil storage area. Mr Head said that NECC are still finalizing <br />their plans as to the material currently stored in DWDA2, (that pile had previously been certified as constructed to <br />the approved final configuration, but with the drainage problems in ditch D14, and at the inlet to culvert C13, the <br />eastern end of the pile has been disrupted). <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />No ponds were discharging but all were holding a good amount of water as a result of the recent snow and <br />rain. <br />The revised discharge permit is still in the public comment period. <br />GENERAL MINE PLAN COMPLIANCE: <br />TR70 was issued on March 24, 2015. <br />RN6 is in progress. <br />OTHER (SPECIFY): <br />The cribbing at the slurry injection well had been repaired. <br />PROCESSING WASTE /COAL MINE WASTE PILES — Rule 4.10 and 4.11 <br />Drainage Control; Surface Stabilization; Placement: <br />No waste had been deposited on the RDA since the last inspection. <br />DOCUMENTS RECEIVED <br />N/A <br />OTHER (SPECIFY) <br />N/A <br />ENFORCEMENT ACTIONS /COMPLIANCE <br />No enforcement actions were initiated as a result of this inspection, nor are any pending. <br />Number of Partial Inspection this Fiscal Year: 7 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 3 of 6 <br />
