Please clarify the discrepancy in the total projected disturbed <br />area and revise the appropriate pages accordingly. <br />2.05.4 Reclamation Plan <br />19. Page 2.05 -38 discusses the removal and reclamation of non - permanent sediment control <br />structures. The last sentence of the last paragraph reads, "Ditches will be reclaimed by reducing ". <br />This sentence and possibly the rest of the paragraph is cut off and incomplete. Please revise this <br />page to include the missing information. <br />2.05.6 Mitigation of Impacts of Mining Operations <br />20. Page 2.05 -63 indicates copies of the approved emissions permit obtained from the Colorado <br />Department of Public Health and Environment, Air Pollution Control Division will be provided to <br />the Division. Please submit a copy of the emissions permit to be included as an exhibit to the <br />permit as required by Rule 2.05.6(1)(a). <br />21. The first paragraph on Page 2.05 -64 indicates 391 acres have the potential to be disturbed. The <br />first page of section 2.05.6 under the "Note to Reviewer: section indicates 355.8 acres will be <br />disturbed incidental to the PSCM underground mining activities. Please clarify the discrepancy <br />in the total projected disturbed area and revise the appropriate pages accordingly. <br />22. Please evaluate the stream depletion calculations for the permit term and update Table 2.05.6(2) - <br />T1 if necessary. <br />23. Page 2.05 -86 indicates that Map 2.04.7 -M1 presents the surface disturbance boundary relative to <br />the drainage basins. This map does not depict the surface disturbance boundary. Please revise <br />this map to depict the surface disturbance boundary. <br />24. Groundwater quality and quantity information found in Section 2.04.7 and Exhibit 2.04.7 -E1 is <br />referenced in section 2.05.6(3) and elsewhere within the PAP. Exhibit 2.04.7 -E1 contains a <br />collection of documents that are not paginated or organized, making it difficult to find specific <br />information. In accordance with Rule 2.03.3(1), please paginate and organize Exhibit 2.04.7 -E1 <br />and create a table of contents for this Exhibit. <br />25. The Division is aware of a Notice of Violation /Cease and Desist Order ( #:10- 120912 -1) issued by <br />the Colorado Department of Public Health and Environment's Water Quality Control Division <br />(WQCD). A subject of the WQCD NOV is the exceedance of the effluent standard of selenium <br />associated with outfalls 002 and 004. Elevated selenium levels are not addressed in the probable <br />hydrologic consequence (PHC) as approved in section 2.05.6 of the permit. In accordance with <br />Rule 2.05.6(3)(b)(iii), please update the PHC section of the permit to reference a potential <br />increase in selenium during mining.
