Please review section 2.03.4(4) of the permit and update Exhibit 2.03.4 -E4 as necessary to list all <br />of the current, previous and pending coal mining permits held by the applicant or by any person <br />who owns or controls the applicant. <br />5. In accordance with Rule 2.03.4(6), please review section 2.03.4(6) of the permit and update the <br />permit text with any changes in ownership that have occurred. Also, if there are any changes <br />please update Map 2.03.4 -M1, M2, M3 and Exhibit 2.03.4 -E4 as necessary. <br />6. Please review section 2.03.4(7) of the permit and update the ownership information with any <br />changes that have occurred. <br />7. Section 2.03.8(2) of the permit indicates the total surface acres to be disturbed (incidental to the <br />PSCM underground mining activities) will be 276 acres. Throughout the permit application, the <br />proposed disturbed area is projected to be 355.8 acres. Please clarify this discrepancy and update <br />the permit text as necessary. <br />10. Please submit an updated Insurance Certificate for Exhibit 2.03.9 -E1. <br />11. Please review the Identification of Other Licenses and Permits listed under Section 2.03. 10 of the <br />permit and update the list with any new licenses /permits obtained and update the status of any <br />pending licenses or permits if they have been obtained. Please also include any new licenses and <br />permits not on this list that have been applied for but have not yet been obtained. <br />12. In accordance with Rule 2.03.12, please revise Exhibit 2.03.12 -E1 by submitting a copy of the <br />newspaper advertisement and proof of the publication of the advertisement required by Rule <br />2.07.3(2) no later than four weeks after the last date of the publication. <br />2.04.3; Site Description and Land Use Information <br />13. Page 2.04 -6 indicates 75% (175 acres) of the proposed PSCM surface disturbance area has been <br />affected by the Seneca II Mine. Throughout the permit application package, it is cited that the <br />total surface disturbance area will be 355.8 acres, of which 67 acres will be new disturbance and <br />288.8 acres is existing disturbance from previous mining activities.
