March 24, 2015 C- 1981- 008/New Horizon Mine BFB <br />pond. <br />The willows in ditch C17, west of Pond 7, have been removed. There are three culverts in ditch C17 that appear to <br />be for farmer field access (photo 4). These culverts need to be added to Map 2.05.3(3) -1 and need to be cleaned <br />out. <br />GENERAL MINE PLAN COMPLIANCE: <br />An impromptu meeting with Mr. Mike Morgan took place on March 24 near Pond 11. Mr. Morgan <br />requested that the section of the BB Detour Road immediately west of Pond 11 have the road base material <br />removed, but that the area not be topsoiled or seeded as directed in TR -65. The area of his request is a long thin <br />strip of land approximately %2 acre in size, bordered on the east by Pond 11, the Enstrom property fence line on the <br />west and the BB Road to the north (photo 5). Mr. Morgan feels that getting irrigation and other farming <br />equipment in this area would be very difficult. DRMS will work with WFC to accommodate this request. <br />A meeting was held on March 25, 2015 at the New Horizon Mine office to discuss topsoil redistribution on Mr. <br />Mel Staats property. In attendance were Rick Wolney (WFC), Frank Ferris (WFC), Mel Staats (landowner) and <br />Brock Bowles (DRMS). According to records, Mr. Staats and WFC had a 1995 agreement that 0.8 feet of topsoil <br />would be replaced on Mr. Staats land once Phase III bond release was achieved. Mr. Staats has been observing the <br />latest mine site reclamation and wants to know when Phase III bond release will happen and when he will get his <br />topsoil replaced. Rick Wolney is in agreement with Mr. Staats that WFC is to replace his topsoil. WFC and the <br />Division will determine where Mr. Staats' property is at in the phase release process and determine the next <br />appropriate steps to achieve Phase III release. <br />ROADS — Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3); Drainage 4.03.1(4)/4.03.2(4); Surfacing and Maintenance 4.03.1(5) and <br />(6)/4.03.2(5) and (6); Reclamation 4.03.1(7)/4.03.2(7): <br />Road base was spread on the BB Road between 2700 Road and Enstrom Draw (photo 6). During the <br />inspection, Montrose County Road and Bridge sprayed the road base with water and magnesium - chloride. WFC is <br />working with Montrose County to install underground phone cable on the north side of the road and underground <br />electric cable on the south side of the road. WFC has not turned over the BB Road to Montrose County yet. <br />The North East Haul Road reclamation was still in progress during this inspection. Culverts 108, 109, 110 and <br />111 were removed and the drainages were re- established (photo 7). Topsoil was spread and disced from 2700 <br />Road, east to topsoil pile F. A black irrigation pipe, approximately 10" in diameter, was left in place in the culvert <br />110 drainage channel (photo 8). The end of the black irrigation pipe is capped with a metal fitting. The pipe is <br />buried underground starting at the bottom of the drainage and appears to go west. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />The green mulch cover crop on the Morgan property was starting to sprout (photo 9). <br />REVEGETATION — Rule 4.15 <br />Vegetative Cover; Timing: <br />Number of Partial Inspection this Fiscal Year: 7 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 3 of 6 <br />
