Hays, Environmental Protection Specialist
CC: Division 1 Office, District 3 Water Commissioner
FROM: Sarah Brucker, P.E.
RE: Loloff Pit, File No. M- 1985 -112
Applicant /Operator: Loloff Construction, Inc.
Inspection Contact: Darwin Derr, Milt Iron Mining LLC, (970) 301 -4292
NWIA Section 4, Twp 5 North, Rng 65 West, 6th P.M., Weld County
CONDITIONS FOR APPROVAL
❑ The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground
water must not occur during or after mining operations.
® The proposed operation will consume ground water by: ® evaporation, ® dust control,
® reclamation, ® water removed in the mined product, ❑ processing, ❑ other:
Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit or
other type of well permit, as applicable. However, prior to obtaining a permit, an approved water
supply plan or decreed plan for augmentation is required.
❑ The applicant has indicated plans to use other water at the permit site for the following purposes:
❑ dust control, ❑ reclamation, ❑ processing, ❑ other:
COMMENTS: The Loloff Pit is a surface mining operation on a total of 55.17 permitted acres. The primary
commodities mined at the site are sand, gravel, and soil for construction materials.
The application seeks an amendment to increase the affected area from 42.7 acres to approximately 48 acres
in the Reclamation Plan. The additional area was initially proposed to be used for a shop and storage area that
has never been used as such, and is now proposed to be mined. The amendment does not seek to increase the
total permitted acreage. This office has no objection to the proposed amendment.
The Loloff Pit is operated pursuant to the Loloff Substitute Water Supply Plan (WDID 0302524) which is
currently valid through December 31, 2015. Well permit no. 77467 -F has been issued for the gravel pit.
The site is proposed to be reclaimed to developed water resources. The pit must be included in a substitute
water supply plan or decreed plan for augmentation until such time as the pit is lined and the liner approved
by this office.
Any storm water runoff intercepted by this operation that is not diverted or captured in priority must infiltrate
into the ground or be released to the stream system within 72 hours. Otherwise, the operator will be required
to make replacements for evaporation.
The applicant may contact the State Engineer's Office with any questions.
CoQ\\
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3585 www.water.state.co.us
\878j
