Sales of sand product have been increasing annually for several years at this location. We are <br />taking measures to further decrease the existing stockpile size out of respect for the concerns of <br />the Office and the complainant. We do not consider all of these measures to fully conform to our <br />interests or that of the market. Regardless, we remain open to discuss reasonable measures to <br />better compliment the diversity of views and concerns involved. None - the -less, we do not <br />believe it necessary to accommodate subjective value sentiments of complainants when the <br />greater good must be held subservient to a lawful enterprise that offends their sensibilities, but <br />cause no harm. <br />Neither is it compelling to reflexively submit to the views of the Office by force alone. We <br />highly value and desire to maintain good relations with our regulatory counterparts. The future <br />tranquility and longevity of our continued operations require that. Yet until this matter can be <br />resolved in the light of day, we cannot ignore the concern or the attending abuse of discretion <br />that we fear if we yield on this question. <br />Again, we are ever ready to work with the Office to seek mutual and beneficial solutions to the <br />challenges before us for good, just, and lasting purposes. We remain ready to work in concert <br />with the Office, consistent with the terms and spirit of the law, sound conservation principles, <br />and good judgment. <br />In the instance of the matters pertaining to the 28 August 2014 inspection report, we respectfully <br />request that the corrective actions asserted in that inspection report be considered abated, and <br />demands for any correlated increase in financial warranty withdrawn.
