Varra, Vice - President of Operations <br />Subject: M- 1999 -006 Kurtz Project — R� to the Colorado Office of Mined Land Reclamation <br />(the Office, a. c.a., OMLR) Inspection Report of 28 August 2014. <br />NOTE: Operator may also meet the definition of Extractor, under 34 -32 -101. <br />Dear Peter: <br />Our Office of Special Projects has researched diverse records in examination of the merits of the <br />OMLR concerns, originally attributed to a citizen complaint. While we have not received any <br />written or physical evidence of that complaint, our understanding is that it was made <br />immediately prior to the referenced inspection of this location last August. Further, it is our <br />understanding that the complaint was cause of that inspection, and contributed to the <br />perspectives of the OMLR in its subsequent communications with Varra Companies, Inc. (Varra <br />Companies). Here is our analysis and perspective as it pertains to the concerns addressed in the <br />OMLR inspection report of 28 August, and subsequent communications between us: <br />The referenced inspection report was not signed until 16 October and received the same date via <br />e -Mail delivery. At play is the intent of OMLR to place a financial warranty burden on a <br />commercial deposit by classifying the product as a waste. Other concerns expressed in that <br />inspection report will be attended to as part of this reply. <br />The inspection report requested a follow -up meeting to discuss the sand stockpile, resulting in a <br />telephone conference of 24 October. One of the determinations of that conference was for the <br />Office to redirect this unique perspective for a broader discussion with the larger industry under <br />the auspices of the Colorado Stone, Sand & Gravel Association ( CSSGA). Subsequently, Chris <br />and Garrett Varra met directly with you and Tony Waldron, at the OMLR on 13 January 2015, <br />where a plan for a broader inclusion and participation regarding this concern with members of <br />the CSSGA was affirmed. <br />
