Racine Circle <br />Centennial, CO 80111 <br />Re: Rueb Borrow Pit, Permit No. M- 2015 -011, 111 Construction Materials Special Operation <br />Reclamation Permit Application, Adequacy Review <br />Dear Mr. Bell, <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the Castle Rock <br />Construction Company of Colorado, LLC 111 Construction Materials Reclamation Permit Application for the <br />proposed Rueb Borrow Pit, File No. M- 2015 -011, and submits the following comments. The Division is <br />required to make an approval or denial decision no later than April 11, 2015; therefore, a response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. In order to <br />allow adequate time to review your responses to any adequacy issues, please submit your adequacy responses to <br />the Division no later than April 10, 2015. <br />The review consisted of comparing the application content with specific requirements of Rules 1, 3, 6.1, 6.2, and <br />6.3 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br />Construction Materials. Any inadequacies are identified under the respective exhibit. The Applicant may update <br />the application and respective exhibits or respond directly to the inadequacies numbered below. <br />Exhibit B — Site Description (Rule 6.3.2): <br />1. During the pre - operational inspection conducted March 26, 2015, the Division observed the site and it <br />appears that stormwater would drain to the west and to the east due to the site spanning across a small hill <br />located between two drainages that flow to the north. Even though the Mining Plan Map depicts this, please <br />revise the statement in the paragraph numbered 8 in Exhibit B to explain how the water currently drains <br />from the site and how water will drain after reclamation is complete. <br />2. Please change "South Platte River" to the "South Fork Republican River" in the following statement <br />(application paragraph numbered 8 in Exhibit B): after reclamation the pit will ultimately drain toward to the <br />north and east (as the property does currently) and ultimately to the South Platte River to the north. <br />Exhibit C — Mining Plan (Rule 6.3.3): <br />3. The Applicant states that the topsoil will be stripped and stockpiled to the south of the affected area. The <br />Mining Plan Map depicts the location of two topsoil piles located along the east and west boundaries. Please <br />clarify this discrepancy and update the Mining Plan narrative or Mining Plan Map if necessary. <br />4. Under the requirements of Rule 6.3.3(k), please state if refuse and acid or toxic producing materials will be <br />exposed during mining.
