Bowles Environmental Protection Specialist Division of Reclamation, Mining and Safety 1313 Sherman St., Room 215 Denver, Colorado 80203 RECEIVED MAR 3 0 2015 Division of Reclamation, Mining & Re: New Horizon Mine (Permit No. C- 1981 -008), Technical Revision No. 66 (TR -66), Dryland Pasture Reference Area (CHS #67409) Dear Mr. Bowles: Thank you for your correspondences dated March 13, 2015 and March 20, 2015 (received by our office on March 17, 2015 and March 20, 2015 respectively) regarding the establishment of a dryland pasture reference area or benchmark for reclamation activities to be completed elsewhere. As this revision does not involve surface disturbance within the referenced area, it is not likely the type of activity that has the potential to cause effects to historic properties. Consequently, it is our opinion that a finding of no historic properties affected is appropriate for this undertaking pursuant to 36 CFR 800.4(d)(1). The consultation process does involve other consulting parties including local governments and Tribes, which as stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional information provided by these consulting parties may cause our office to re- evaluate our comments and recommendations. If previously unidentified archaeological resources are discovered in the course of the project, work must be interrupted until the resources are properly evaluated in terms of the National Register of Historic Places eligibility criteria (36 CFR 60.4) in consultation with our office.
