C:oio ado 8"')/03 <br />STAFF SUMMARY FORM FOR <br />CONSENT AGENDA ITEMS <br />Date <br />March 4, 2015 <br />O erator <br />Asphalt Specialties <br />Permit No. , <br />M- 2004 -009 <br />Site Name <br />Turnpike Mining Resource <br />Specialist <br />Eric Scott <br />Objecting Part <br />N/A <br />Permit Type <br />112C <br />Permit Acreage <br />200.4 <br />Action: <br />Action <br />Check <br />Permit application with objections <br />Violation <br />X <br />Extension of Board - ordered <br />deadline <br />Other (specify) <br />Resolution: <br />NATURE OF VIOLATION. <br />This item is in regard to a Notice of a Possible Violation, corrective actions, and civil penalties for a <br />possible violation pursuant to C.R.S. 34- 32.5 - 124(1) for failure to comply with the conditions of a <br />permit; specifically, the Operator affected area and removed old growth trees within the 100 foot setback <br />distance from Boulder Creek in violation of provisions of Amendment 1 of the permit. <br />CHRONOLOGY.- <br />February 10, 2015 — DRMS received a citizen complaint stating that Asphalt Specialties was affecting <br />area well within the 100 foot setback area from Boulder Creek, and had cut down several old- growth <br />cottonwood trees. <br />February 18, 2015 - DRMS conducted an inspection of the permit and surrounding area and observed: <br />Disturbance well within the 100' setback area from Boulder Creek, and a pile of removed, old- growth <br />cottonwood trees. During the inspection Asphalt Specialties stated that they had been creating sediment <br />settling ponds for use at the site.
